PRESIDENTIAL POWERS UNDER THE CONSTITUTION-PART 2
63PREFACE
My fellow American’s in my previous hub I elucidated on the nature of the democratic republic in which we live. I gave specifics on The Constitution and various and several powers enumerated in that great document. My purpose is to further espouse on this great document on which The United Stated of America was founded. I will continue on the Executive branch of our government.
I would like to examine further powers as they relate to the executive branch today. One of the further enumerated powers is also shown in the previously examined article, Article II, Section 2.
ARTICLE II SECTION 2
I ask that you read and digest the information shown below:
Article. II. - The Executive Branch
Section 2 - Civilian Power over Military, Cabinet, Pardon Power, Appointments
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any subject relating to the Duties of their respective
Offices, and he shall have power to grant reprieves and pardons for offences against The United States, except in Cases of Impeachment.
Do you understand the information highlighted above? Do you know the ramifications and implications of this power of the Executive branch having total control over our military? If not please read it again and try to concentrate on the information.
I think that all of you are able to comprehend the possible ramifications of this unfettered power over the military and militias. If used with evil intentions the results could be horrific. President Obama could constitutionally order anything of our military even against Americans. He could further order the military to stand down even though the homeland was under attack. I’ll give you a moment to let that information sink in.
Now turn your attention back to present days. Think of the various actions and pronouncements of President Obama that show distain for both the American people and The Constitution. This man makes habit of going against the “Will of the American People”. I will further enumerate examples (some identical to yesterdays) of such behavior below:
- Think of the Presidential appointees who have questionable backgrounds.
- Think of the bribes in the Health Care legislation.
- Think of the legislation by fiat as practiced by President Obama to placate Representative Stupak in his fight for innocent babies!!!!!!
- Think of the numerous times he has demeaned the American people and even mocked by saying we should be grateful for paying taxes to support his stimulus boondoggle. What is a saved job?
- Think of his background of being Muslim born and his conversion to Christianity in a church where he worshiped for over twenty years and claimed he never heard the hate speech against America even though he wrote it in his book prior to campaigning for president.
I have but one more question to ask you, How long before military action is ordered against legitimate protesters? Have the orders already been written? Remember the Chicago way if they bring a knife you bring a gun. Our cutting words are metaphorical knives so what about those orders? They are signed, sealed and delivered just waiting for the time they are needed!!!!!!!!!!!!!!!!!!!!!!!
Our brave soldiers may resist such orders but once given, the fabric of the nation is rent beyond repair!!!!!!!!!!!!!!!!!!!!!!!

I don't believe our military will ever turn against us. They have learned, if not in school, then while in the military, that they cannot follow an illegal order. I'm not saying the President won't try to use them - too much evidence he's heading that way - but I don't believe the military would follow his orders.
Good hub on the 2nd section of the constitution. I think there very well may be violence this summer against the tea party people but made to look like they caused the problem. Then Obama can call out the troops from Fort Steward and act like he's restoring order in the country. I hope I'm wrong. Good hub.

Pretty f-ing scary isn't it. My hubby and I were talking about that very scenario the other day. I explained that the sob could actually ORDER the military to attack the protesters, and they would be going against orders if they refused. God help us all.
And even a military presence to 'keep peace' can end in tragedy. Remember Kent State! They said they fired cause they saw students with guns. As memory serves, no guns were found.
Tom - You make many good points in the hub and these are things we must each consider in our candidates before we elect them. But some of the added conclusions here are not quite in line with history, The troops at Kent State were Ohio National Guardsman called out by the Governor at the time, during this period in our history the Guard nationwide was poorly trained for these types of duties, and were a haven for those trying to avoid being drafted and sent to Vietnam. Most Vietnam vets that had a service obligation to complete did so in the Reserves (which are different than the Guard). It was this poor training, lack of experience, and the confontational nature of the demonstrators that led to the shootings.
Fast forward today, The Tea Party folks, are demographically different in that they are generally the age to be a troops mom, dad, or grandparent (and many of the are). They make their voices heard by hollering louder, not by putting bombs at the doors of campus buildings.
I have a hub that points out that our troops oath is not to the president but to the constitution and our officers have an obligation in their oath to evaluate their orders and disobey when the do not uphold the constitution. I will continue to trust in the judgment of them as I have for so many years to "support and defend the Constitution of the United States against all enemies foreign and domestic."
Terrifically frightening hub Tom. I just read about the very real possibility of troops being turned loose on the public in the event of civil unrest. Pamela forwarded me the info about training going on in Fort Stewart, GA. This can't be happening, it's unreal.
I learnt a lot from the hub and the comments - on the military and Presidents all I can say is nothing would surprise me.
Tom - At your request I continue these comments, Federal Troops have been used in the past to do several things, last time in the labor arena was the Air Traffic Controllers Strike in the 80's. Federal Troops have been deployed in Natural Disasters both at home and abroad. The last time they were used in a 'political' fashion was to integrate the schools in Little Rock Arkansas (not a shot fired).
The information provided about 1st Brigades is erroneous since it was written in 2008 and the 1st BCT 3rd ID is currently in Iraq, I have friends in this unit.
The tragedy at Kent State, led to the continuous training of military units in how to handle civil unrest Both in the Guard and the Active duty forces. To assume that somehow US Military troops would be unleashed on peaceful protesters (like the Tea Party) is stretching an unlikely scenario. Training in these conditions is especially useful for units deploying overseas and has been on going in earnest since troops were deployed to Bosnia, (My late wife used to act as a role player in this training) and there is no substitute for the realism it provides. By putting the troops through tough and realistic training, you save lives of both troops and protesters. I hope this helps
Tom - Essentially yes, I have many friends of various political persuasions including Tea Party folks. I have also in my career trained for crowd control. The point of crowd control is to protect life and property in that order, Many of the lessons learned at Kent State, are still used today, such as leave an avenue of retreat open for civil protesters. As most will choose to use it rather than clash with the crowd control force.
One of the reasons Combat Brigades are OPCONed to NORTHCOM is a review of the Katrina Response. When FEMA needed Federal Troops, none were under their (NORTCOM)control and it created delays, now when a unit is designated as such it develops training regime focused on disaster relief, and yes civil unrest and other Law Enforcement support. They also practice mass casualty exercises in case of terrorist attack.
Troops should be the least of peaceful protesters worries, what all sides should emphasize and be vigilant for are the infiltration by the clowns who would damage their cause by violence.
What the politicians and media should do is make sure you are not dealing in speculation about the motives or intent of peaceful protests. They are what they are until they show otherwise.
